Had a Payday loan that was about 3 to 4 yrs ago. I lost my job and this company didn’t want to work with me. I gave up and decided to just to let them do what they would. I was told that it was a loan and all they could do is to file against my credit. Well today I got a letter for the city of Midland courts (Midland, Tx) stating that I have an warrant issued for a hot check. First off I never got a letter stating that someone has turn a check in or even time to get this problem resolved. And the other problem is that they sent it to an address that I haven’t been living at for the last 8 months. I’m looking for a legal way to get this thrown out of court. HELP PLEASE!!!!
For those that think they know the law, here is right out of the state Payday Loan Laws of Texas
Under Texas law, a lender cannot pursue criminal charges to collect on a debt. Also, a payday loan lender is limited as to how many times a loan can be renewed. Currently under Texas law, lenders are allowed to renew a payday loan one time each month.
